Abstract / Description:The Westminster government has recently proposed a Supreme Court for the United Kingdom. This would replace the House of Lords as the final court of appeal in civil and criminal matters in England and Wales and Northern Ireland; and, in civil matters, in Scotland. One of the issues in the Consultation is that of representation on the Bench. The writer argues that a continuation of the status quo, whereby Scottish judges are usually in a minority, is not compatible with the Human Rights Act 1998.
